Even though the Maharashtra Electricity Regulatory Commission (MERC) had sanctioned the PPAs, Reliance Infrastructure had submitted an appeal opposing the power allotment in the Supreme Court. The Supreme Court’s authorization has brought the protracted to an end.
Tata Power stated that the apex court, alluding to Section 23 of the Electricity Act of 2003, also affirmed that the Act does not provide any authority to MERC to allot any power to a non-contracting discom.
