Spain’s energy commission has imposed conditions on the bid in 2007 even after the European Commission cleared it. The country has even requested the Court of First Instance in Luxembourg for an injunction on its conditions. However, the court rejected the application. The European Commission has exclusive power on international deals within the EU.
