In August 2009, the Richmond Circuit Court judge has revoked the plant’s permit, ruling that the Air Pollution Control Board should have set a firm limit for the plant’s mercury emissions, after the commencement of the construction.
The Virginia Department of Environmental Quality (DEQ) issued a draft air permit for the project, Sourcewatch reported.
The Virginia City power plant is 36% completed and is due to commence its commercial operations in 2012. The company’s proposed power plant has a power generation capacity of 585MW.
